Contest Rules and Legal Disclaimers:
Contestants agree to all terms and legal disclaimers regarding this contest, and by the decisions of Clearly Chiropractic and of the Judge, which are final and binding on all matters pertaining to the context.
Contest Summary: This is an essay skill contest whereby individuals choosing to participate pay a $200.00USD contest entry fee and submit a written essay of 500 words per entry. All entries must be the creation of the contestant, unique for this contest, and must not infringe upon the rights of any other person or entry. There is no element of chance. The prize is a chiropractic practice in Lakewood, Colorado, United States if the target number of 1,000 (one thousand) entries is received. The contest’s deadline will end immediately after the last entry of 1,000 is received.
Eligibility:
To be eligible to win, a contestant must be at least 18 years of age, pay the $200.00USD entry fee, be legally legible to own a business, and agree to comply with these Official Rules and Regulations. This contest is open to all chiropractic doctors and chiropractic students[1] world-wide and is void wherever prohibited by law. The Judge of the Contest, as well as that individual’s immediate family members and the residents of his households, is not eligible. The Judge reserve the right, exercisable upon his sole discretion, to disqualify any individual he finds has (1) violated the Official Rules and Regulations; (2) interfered with, or attempted to manipulate the Contest or Contest results; (3) violated any law or regulation by participating in the Contest; or (4) provided false information to the Judge. By entering the www.chiroessay.com (Clearly Chiropractic) essay contest, contestants consent to be bound by these Official Rules and Regulations, which shall constitute a contract between entrants, Clearly Chiropractic and the Judge. All decisions of Clearly Chiropractic and the Judge, with respect to the Clearly Chiropractic contest, shall be final.
Eligible individuals may enter the Contest by submitting a qualified entry and entrance fee to CAM Management Solutions, 29193 Northwestern Highway, #530, Southfield, Michigan 48034, United States during the Contest Period. An individual may enter as many times as she/he desires so long as each submission satisfies the entry requirements. The prize will be awarded only to the name submitted upon the winning entry form. To qualify for entry into the Contest, all participants must complete the essay questions in 500 words or less and submit their payment with the essay in the form of personal check, money order, or cashier’s check made payable to CAM Management Solutions. Once submitted, the entrance fee will not be refunded.
Format:
Essay should address the following:
“What this opportunity of receiving a chiropractic office would mean to you, how you plan to forward the practice of chiropractic, and why you decided to become a chiropractor.”
Essay must be written in English and be no more than 500 words. Essay should be titled “Clearly Chiropractic Essay Contest” and should follow standard essay format. Nonfiction only. No endnotes or footnotes.
To ensure anonymity, the essay text should not include your name, age, or gender. On a separate sheet of paper attached to the top of the essay, please provide the following contact information: email address, phone number, and mailing address. Clearly Chiropractic will assign each entry with a unique code.
The Judge:
There will be one impartial judge. The entries will be judged based on answers to the 500 word or less essay question. This is a contest of “skill” and there are no “odds” of a particular entry being chosen by the Judge. The Judge will evaluate essays without knowledge of the entrant’s identity and select the Winner on the basis of readability, clarity, organization, originality, and how the essay addresses the topic statement. The Judge’s decision will be announced two weeks after one thousand paid eligible entries have been received. The Judge will contact the Winner with the information provided. The Winner will also be announced on www.chiroessay.com. There will be a first place runner up chosen in the event that the Winner is disqualified, is unable to fulfill the terms and conditions and/or Winner Responsibilities. There will be a second place runner up chosen in the even that the first place runner up is disqualified, is unable to fulfill the terms and conditions and/or Winner Responsibilities.
Contest Period:
The Contest shall begin 12:00 a.m. (midnight) Mountain Standard Time, February 1, 2010, and end immediately after the one thousandth paid entry is received, (“Contest Period”). All entries must be received before posting on the website that 1000 entries have been received unless extended or shortened by the Judge in accordance with these rules. The Contest Period may be extended for a period in the event that the end of the Contest Period, the Entrant Number Amount does not, in fact, meet the required Entrant Number Amount (1,000). If the entrant number amount (1,000) is not met, the Contest Period does not end until the entrant number amount is reached.
Prize:
The prize is the office/practice known as Clearly Chiropractic located at 2480 Youngfield Street, Lakewood, Colorado, United States.
The Prize includes all working equipment (please see attached list), additionally, all necessary and ordinary supplies will be stocked for the Winner at the beginning of the Transition Period*.
The Winner will be assisted in obtaining new lease terms with the current landlord and first year’s rent, up to $11,400.00, will be paid. Winner has the option to move the office and all equipment to another location, at Winner’s own expense; however, in this event, the first year’s rent will not be paid.
The existing services at the time of the Transition Period, including, but not limited to phone, phonebook ads, utilities, will be fully paid at that extent of the current rate. Any additional services, not existing at the time of the Transition Period, including, but not limited to, internet and new advertisements, are the responsibility of the Winner.
The Winner will obtain the rights to the office’s phone number, which has been associated with the office for over 20 years.
Winner Responsibilities:
In the event that Winner is unable to fulfill these responsibilities, Winner forfeits the prize and the next runner up will be notified.
The Winner is responsible for changing all existing services, including, but not limited to, phone, utilities, credit card machine, within 30 days after the start of the Transition Period.
The Winner is responsible for changing the legal ownership of Clearly Chiropractic into the Winner’s own name, resulting in the complete transfer of ownership, within 30 days after the start of the Transition Period.
The Winner is responsible for obtaining business insurance within 30 days of the beginning of the Transition Period.
Any personnel employed or newly employed in the office will be the Winner’s financial responsibility.
The Winner is responsible and required to carry his/her own malpractice insurance and other insurance he/she wishes to carry at the Winner’s expense.
At the choice of the Winner, the Winner is responsible in obtaining in-network status of desired third party payers[2] before the end of the Transition Period. The Judge will assist the Winner in obtaining any in-network status; however the Judge cannot guarantee obtaining any in-network status sought. The Judge will be available for third-party payer reasons for the winner during the Transition period.[3] After the end of the Transition Period or when the Winner obtains in-network status, no services will be rendered under the Judge’s supervision.
The Winner is responsible for acquiring new patients and maintaining current patients.
The Winner is responsible for any and all new equipment and/or furnishings.
Any and all attorneys’ fees initiated by the Winner will be the responsibility of the Winner.
The Winner will be responsible for his/her own transportation and hotel expenses relating to the prize and any and all federal, state, local or other taxes associated with the prize awarded, if any due.
The Winner is responsible for obtaining a Colorado chiropractic license and meeting all criteria, as required by the State of Colorado to obtain it, including, but not limited to, the NBCE I-IV and PT part.
The Winner has the right to refuse the prize, at no consequence; however, the entry fee will not be returned. If the Winner is unable to fulfill the terms and conditions and/or Winner Responsibilities of the contest, the Winner forfeits the prize and the first runner up will be offered the prize.
*Transition Period:
The Transition Period must begin within one month of the Winner being announced. If special circumstances arise, at the discretion of the Judge, including, but not limited to, graduation from chiropractic school, waiting to take the board or waiting for results, the Judge will offer a grace period for up to two months (60 days) for chiropractic students and one month (30 days) for chiropractic doctors which will postpone the Transition Period’s start. At the end of this grace period, the Transition Period will begin automatically regardless of the circumstances.
Winner has the right to refuse the Transition Period, in writing, and to take full ownership and responsibility immediately.
After the start of the Transition Period, the Winner may terminate the Transition Period at any time but only after two-weeks written notice is given to the Judge.
The Transition Period is for a maximum of one month (30 days). During this time period, the Judge will assist the Winner on a part-time basis in operating the chiropractic practice. The Judge will provide training on running the business/office, using equipment, and billing. The Judge will help with existing patient care as much or as little as the Winner requests. The Winner will be assisted with current patients’ treatment preferences, if the Winner so requests.
The maximum number of hours per week provided by the Judge is 20 hours in office and will be available by phone after the 20 hours. The Judge will choose to either personally be in the office or choose another qualified individual to fulfill this duty.
The Winner will receive any collections from the start of the Transition Period and forward; except for any services performed under the Judge’s name solely. Any services performed or money earned prior to the Transition Period belongs to the Judge.
Prize Notification:
The Winner will be notified in one of the following ways: phone, email, on the website, or in writing by overnight courier within 10 days of the prize being awarded. If the Judge is unable to confirm the winner within 14 days of notification being sent, or if a winner is disqualified, then the prize is forfeited and awarded to the next best entry (first runner up). The name of the winner will be posted on www.chiroessay.com.
As a condition of awarding the prize, the potential Winner is required to sign notarized affidavits of eligibility, publicity and liability release and return them properly executed within 10 business days from the date the potential Winner is notified. If a potential Winner fails to return the affidavits as specified, that potential winner will be disqualified and an alternate winner may be selected.
The Judge has made every effort to display the prize as accurately as possible. The site cannot be responsible for the limitations of each individual monitor’s display of color, texture, or detail of the images included in the prize. The documents and related graphics published on this server could also include technical inaccuracies or typographical errors.
There will be a first place runner up chosen in the event that the Winner is disqualified, is unable to fulfill the terms and conditions and/or Winner Responsibilities. There will be a second place runner up chosen in the even that the first place runner up is disqualified, is unable to fulfill the terms and conditions and/or Winner Responsibilities.
Copyright Ownership and License:
Each contestant’s city, state, and contact information are non-confidential for purposes of this Contest. Clearly Chiropractic may disclose this information in conjunction with announcements related to the prize Winner and the contest. By participating, each contestant further agrees that such submissions, of his/her completed entry shall become the sole property of Clearly Chiropractic and that all title and interest shall rest with the Judge at the time they are submitted.
Governing Law:
Clearly Chiropractic controls this site. This site can be accessed from countries around the world. As each of these jurisdictions has laws and regulation that may differ from those in Colorado, by accessing this site both the contestants and the Judge agree that the statutes and laws of Colorado, without regard to conflicts of laws principles thereof, will apply to the Contest, including any legal proceedings between the parties hereto shall be brought only in Colorado or United States Federal Court having subject matter jurisdiction in Lakewood, Colorado.
By participating in this contest, contestants have irrevocably and unconditionally consented to the jurisdiction of any such court and hereby irrevocably and unconditionally waive any defense of inconvenient forum to the maintenance of any action or proceeding in any such court, any objection to venue with respect to any such action or proceeding, and any right of jurisdiction on account of the place of residence or domicile of any party thereto.
Limitation of Liability:
In no event will Clearly Chiropractic, the Judge, their representatives or agents, immediate family, members or residents of their household, their affiliates or employees and partners, the web designer or their respective officers, directors, employees, representatives or agents, immediate family members or residents of their households be responsible for liability for any damages or losses of any kind, including direct, indirect, incidental, consequential, statutory or punitive damages. Without limiting the foregoing, with respect to the Contest and to the Prize, the Judge makes no warranty of any kind, either express or implied, including, but not limited to, the implied warranties or merchantability of fitness for a particular purpose. Some jurisdictions may not allow the limitations or exclusions of liability for incidental or consequential damages or exclusions of implied warranties so some of the above limitations or exclusions may not apply to you. Check local laws for any restrictions or limitations regarding these limitations or exclusions.
Amendments of Rules:
Clearly Chiropractic may amend the Official Rules at their sole discretion. Amendments will be posted on the website: www.chiroessay.com. Unless otherwise specified, any amendments will become effective on the day they are posted on this site.
Other Conditions, Rules or Terms of Entry:
By entering this Contest, each contestant accepts and agrees to be bound by these Official Rules and Regulations and the decisions of Clearly Chiropractic and the Contest Judge. Clearly Chiropractic and its agencies are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of submissions in the Contest. Clearly Chiropractic and its agencies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of unauthorized access to, or alteration of entries. Clearly Chiropractic and its agencies are not responsible for any problems or technical malfunction of any telephone network or lines, computer systems, servers or providers, computer equipment or software on account of technical problems or traffic congestion on the Internet or combination thereof, including injury or damage to participants or to any other person’s computer related to or resulting from participating or downloading materials in this Contest. Submissions that are disqualified for not following the guidelines noted above will not be eligible for a refund of the entry fee. Any submission received incomplete may be voided and disqualified. Submissions are considered void if illegible, incomplete, irregular, or obtained through fraud or theft. Any illegal activity or submission will be reported to the appropriate authorities.
The prize, the Clearly Chiropractic practice, will be awarded fully furnished. The practice will be awarded as is and without warranty of any kind, expressed or implied.
Winner will be responsible for any and all federal, state and local taxes associated with the prize awarded, if any due and costs associated with the necessary travel to claim the prize. Clearly Chiropractic is not a tax advisor and/or law firm and so cannot answer any questions related to taxes or laws, nor give any tax or legal advice. Questions related to taxes and the law should be directed to a qualified tax advisor and/or lawyer.
Entire Agreement:
This agreement, including exhibits (if any), contains all agreements between the Parties. Void where prohibited by law. There are no other representations, warranties, or promises agreements or understandings, oral, written or implied, among the Parties, except to the extent reference is made thereto in this Agreement.
[1] At the time of entry, a Chiropractic Student needs to be no more than one year and half from graduation from a chiropractic college.
[2] Third Party Payer is a health insurance company
[3] Judge is currently in-network for some health insurance companies. Since the process of becoming an “in-network provider” takes about seven to twelve months, the Judge will be available to supervise the care which will allow the Winner to submit bills to the health insurance company to receive reimbursement for the services they provide.
